End User Agreement

Introduction to Global HR Research.

Welcome to Global HR Research. We provide consumer reports for employment and other permissible purposes; drug, alcohol, and occupational screening services; E-Verify Employer Agent services; electronic Form I-9s; and other similar services (hereafter, collectively, “Services”).

Agreement.

This is an Agreement for Services between Global HR Research, LLC, a Delaware limited liability company with its principal place of business at 9530 Marketplace Boulevard, Suite 301, Fort Myers, Florida (“GHRR,” “us,” “we,” or “our” as the case may be) and {{CLIENTNAME}} at {{CLIENTADDRESS}} (hereafter, the “Customer” or “Company”) effective as of {{NOW}}.

In consideration of Customer’s promise to pay for Services rendered as more particularly described hereinbelow, GHRR agrees to provide Services ordered by Customer upon the following terms and conditions. GHRR’s fee for services shall be displayed at the time Customer places an order. (In the event that Customer’s user does not have access rights to view the pricing, user’s administrator can submit a request to GHRR to obtain access rights to view the pricing.) Standard Terms & Conditions.

By ordering Services, Customer agrees to the standard terms and conditions published on our website www.ghrr.com (the “Site”) at www.ghrr.com/EUA/standard-terms-and-conditions (hereafter, “Standard Terms & Conditions”).

Background Screening Terms & Conditions.

When ordering consumer reports from GHRR, Customer agrees to the terms and conditions relating to the procurement and use of consumer reports published on our Site at www.ghrr.com/EUA/consumer-report-terms-and-conditions. Customer further certifies as follows:

  • {{CLIENTNAME}} intends to use the information obtained from GHRR for EMPLOYMENT PURPOSES. If Customer desires to purchase consumer reports for a different permissible purpose, you must contact our Client Care Team and request assistance.
  • {{CLIENTNAME}} has made a clear and conspicuous disclosure in writing to the consumer, in a document that consists solely of the disclosure, that a consumer report may be obtained for employment purposes.
  • The consumer has authorized in writing the procurement of a consumer report by {{CLIENTNAME}}.
  • {{CLIENTNAME}} will obtain a NEW authorization bearing the name of Employment Screening Services and Global HR Research; {{CLIENTNAME}} will NOT rely on an old authorization form. An example of a new authorization form can be found here: ghrr.com/EUA/exemplar_consent.
  • In using the consumer report for employment purposes, before taking adverse action based in whole or in part on the report, {{CLIENTNAME}} shall provide to the consumer to whom the report relates (i) a copy of the report and (ii) a description in writing of the rights of the consumer under Title 15 of the United States Code, as prescribed by the Consumer Financial Protection Bureau under Section 609(c)(3).   • Information from the consumer report will not be used by {{CLIENTNAME}} in violation of any applicable federal or state equal employment opportunity law or regulation.
  • Before placing an order for Services, {{CLIENTNAME}} has received a copy of, has read, and understands the Notice to User of Consumer Reports: Obligations of Users Under the FCRA, a copy of which can be found here: ghrr.com/EUA/Obligations-of-Users/.

Drug Testing & Occupational Health Screening Services.

When ordering drug testing and occupational health screening service agent services from GHRR, Customer agrees to the terms and conditions relating to such services published on our Site at www.ghrr.com/EUA/drug-testing-service-agent-services/.

E-Verify Employer Agent Services.

When ordering E-Verify Employer Agent services from GHRR, Customer agrees to the terms and conditions relating to said services published on our Site at www.ghrr.com/EUA/everify-employer-agent-services/.

Electronic Form I-9 Services.

When ordering drug testing and occupational health screening service agent services from GHRR, Customer agrees to the terms and conditions relating to said services published on our Site at www.ghrr.com/EUA/electronic-form-i9-services/.

Integration, Merger, and Precedence.

This End User Agreement (EUA), and the Terms & Conditions incorporated by reference, constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all prior and contemporaneous covenants, agreements, warranties, representations and understandings of the parties. No party hereto shall be liable or bound to the other in any manner by any covenants, agreements, warranties, representations and understandings with respect to the subject matter hereof except as specifically set forth herein. Any prior agreements between Customer and GHRR or any of its affiliates, including easyBackgrounds, and CSS are merged into this EUA and the incorporated Terms & Conditions and, where there is conflict or ambiguity between the prior agreements and this EUA and its Terms & Conditions, this EUA and its Terms & Conditions shall prevail, govern, and control.

Change of Terms & Conditions.

All of the foregoing terms and conditions are subject to change by GHRR without prior written notice at any time, in its sole discretion. Any change to a term or condition will be effective as of the “last updated date” referenced on the Site. Customer’s continued ordering of Services after the “last updated date” will constitute continued acceptance of, and agreement to, such changes.

Authority to Bind.

Customer represents and warrants that the individual user electronically signing this EUA on behalf of Customer is an agent of Customer and has the authority to sign on behalf of, to bind, and to otherwise contract for the Customer as a lawfully organized business entity and, upon the agent’s electronic signature hereinbelow, the Company agrees to be and hereby is bound by the terms and conditions of this EUA and all incorporated Terms & Conditions.
